1. Acceptance of Terms

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User,” “you”) and OURY (“Company,” “we,” “us,” or “our”) governing your use of the OURY mobile application and related services (collectively, the “Service”).

By accessing or using the Service, the User agrees to be bound by these Terms. If you do not agree, you must discontinue use of the Service.

2. Description of the Service

The Service is a private mobile application enabling Users to upload, store, organize, and privately share personal content (“Content”) with individuals the User designates (“Invited Viewers”).

The Service is intended for private, personal use and is not a public social networking platform.

3. Eligibility

The Service is intended for individuals 13 years of age or older.
By registering, the User represents and warrants that they meet this requirement and that all registration information is accurate.

4. Account Registration and Security

To access the Service, the User must create an account. The User is solely responsible for:

  • Maintaining the confidentiality of their account credentials

  • All activity occurring under their account

  • Notifying the Company of unauthorized use

The Company is not liable for losses resulting from the User’s failure to secure account credentials.

5. Subscription, Free Trial, and Payment Terms

5.1 Free Trial

A 7-day free trial may be offered to new subscribers. Subscriptions begin automatically at the end of the trial unless canceled beforehand.

5.2 Subscription Plans

  • Monthly: $12

  • Annual: $120

5.3 Billing

All payments are processed by the Apple App Store or Google Play Store.
The Company does not collect or store payment card numbers.

5.4 Renewal & Cancellation

Subscriptions automatically renew unless canceled through the applicable app marketplace.
No refunds for partial billing periods except where required by law.

5.5 Pricing Changes

The Company may modify pricing with prior notice to subscribers.

6. User Content & Ownership

Users retain all ownership rights to the Content they upload.

By uploading Content, the User grants the Company a limited, non-exclusive, revocable license to host, store, display, and process such Content solely for operating the Service.

The Company will not sell, publicly display, or commercially use User Content without explicit consent.

The User represents and warrants that they possess the rights necessary to upload their Content.

7. Privacy, Sharing, and Viewer Access

All Content is private by default and visible only to Invited Viewers designated by the User.

Invited Viewers may view Content solely within the Service and may not upload, modify, or interact with Content.

The User may revoke viewer access at any time.

The Company does not publicly surface or distribute User Content.

8. Content Handling & Usage Parameters

The Company may impose or adjust reasonable limits on Content types, storage capacity, upload volume, or other usage parameters necessary for optimal operation of the Service.

9. Prohibited Content & Conduct

Users may not upload or share Content that:

  • Contains sexually explicit material or pornography

  • Contains child sexual content (zero tolerance)

  • Depicts graphic violence

  • Promotes hate speech, threats, or harassment

  • Is illegal or violates any law

  • Contains malware, viruses, or harmful code

  • Violates the intellectual property rights of others

Users may not:

  • Access Content they are not authorized to view

  • Use the Service to harm or harass others

  • Reverse engineer or disrupt the Service

  • Use bots, scrapers, or automated tools

  • Use the Service commercially without written consent

Violation may result in suspension or termination.

10. Notifications

The Service may send push notifications relating to account activity.

Users may disable notifications through device settings.

11. Account Deletion and Data Processing

Users may delete their accounts at any time.

Upon deletion, Content will be permanently removed following a reasonable processing period (e.g., 30 days).

Currently, the Service does not offer:

  • Data export

  • Timeline export

  • Printing or physical product features (these may be added later)

12. Data Security

The Company uses industry-standard security measures to protect User data.

However, no method of transmission or storage is fully secure. Users acknowledge this risk.

13. Service Modifications & Availability

The Company may modify, suspend, or discontinue the Service at any time, with or without notice when practical.

The Service is provided “as is” and “as available.”

14. Third-Party Services

The Service relies on third-party providers such as:

  • Apple App Store

  • Google Play

  • Firebase

  • AWS

  • RevenueCat

Use of the Service requires acceptance of these third-party terms.

15. Limitation of Liability

To the fullest extent permitted by law:

  • The Company is not liable for indirect, incidental, consequential, or punitive damages

  • The Company is not liable for data loss or unauthorized access

  • The Company’s total liability shall not exceed the amount the User paid in the twelve (12) months preceding the claim

16. Indemnification

The User agrees to indemnify and hold harmless the Company from claims arising out of:

  • The User’s misuse of the Service

  • The User’s Content

  • The User’s violation of these Terms

17. Changes to These Terms

The Company may update these Terms.
Significant changes will be communicated through the Service or email.
Continued use of the Service constitutes acceptance of revised Terms.
